Terms of Service

JChere Inc. (hereinafter referred to as "the Company") provides purchasing and international forwarding services to its members (hereinafter collectively referred to as "the Services"). The Company has established the following "Terms of Service" (hereinafter referred to as "these Terms"). The Company may establish additional provisions (hereinafter referred to as "Additional Provisions") depending on specific circumstances. In the event of any conflict between these Terms and the Additional Provisions, the Additional Provisions shall prevail, and the remaining parts shall simultaneously apply to both these Terms and the Additional Provisions. Members may use the Services upon agreeing to and complying with these Terms and the Additional Provisions.

Article 1 (Membership Eligibility)

  1. Definition of Membership
    A member refers to an individual who agrees to these terms, applies for membership through the internet to use the services provided by our company, and is granted membership and a member ID by our company.
  2. Eligibility Restrictions
    Members must be adults with full legal capacity. Members may not allow third parties to use their membership, nor may they lend, transfer, sell, or pledge their membership to others. If our company discovers that a member has engaged in any of the following behaviors, we reserve the right to revoke their membership without prior notice or demand, and our company will not bear any responsibility:
    1. The member is a minor;
    2. The member's membership was previously revoked due to violations of these terms or other misconduct;
    3. The member has provided false or forged information in their membership application, identity verification, order, or other documentation;
    4. The member has unpaid debts to our company;
    5. The member has used someone else's identity to make payments;
    6. The member has repeatedly canceled and re-joined Premium membership during its active period;
    7. The member has violated applicable laws and regulations;
    8. The member has interfered with the operations of our company or the services, or has hindered other members from using the services;
    9. Any other situation deemed inappropriate by our company.
  3. Member Responsibilities
    Members must manage their accounts and passwords independently and may not lend, transfer, or sell their account information. Members are responsible for any losses caused by improper management, and our company will not be liable. Any actions taken using the member ID and password will be considered the actions of the member, and the member will bear full responsibility for their use of the services. If a member's ID or password is discovered by a third party or is suspected of being misused, the member must immediately notify our company and follow the relevant instructions. Members are obligated to change their password regularly, and our company will not bear any responsibility for any losses caused by neglecting this obligation.

Article 2 (Changes to Terms of Use)

  1. Our company may modify these terms and other individual terms at any time without prior notice to members. After the terms are modified, all matters related to the use of the services will be governed by the revised terms.
  2. Members should regularly review the latest content of the terms and agree to continue using the services under the modified terms.

Article 3 (Membership Application)

  1. Membership Application
    Individuals wishing to join (hereinafter referred to as “applicants”) should apply for membership personally through the internet. If the applicant is a minor, they must obtain the consent of a guardian before applying for membership.
  2. Membership Eligibility Review
    The membership registration process is completed once our company agrees to the applicant's membership application as described in the preceding item. However, if our company discovers any of the following situations in the applicant, we may reject their application, and even if membership has been granted, our company may later revoke it:
    1. The applicant is a minor and has not obtained guardian consent;
    2. The applicant's membership was previously revoked due to violations of these terms or other misconduct;
    3. The applicant has provided false, incorrect, or incomplete information during the membership application;
    4. The applicant has unpaid debts to our company;
    5. The applicant has engaged in behavior that interferes with our company's operations or services, or has hindered other members or third parties, including sellers, from using the services, or has engaged in behavior that may cause such interference;
    6. Any other situation deemed inappropriate for membership by our company.

Article 4 (Management of Member ID and Password)

  1. Responsibility Management
    After registration, members are responsible for managing the member ID and password granted by our company.
  2. Prohibited Use
    Members may not allow third parties to use their member ID and password, nor may they lend, transfer, sell, or pledge them to others.
  3. Security Responsibility
    Members are responsible for any losses caused by improper management, misuse, or unauthorized use of their member ID and password. Our company will not bear any responsibility. Additionally, any actions taken using the member ID and password will be considered the actions of the member, and the member will bear full responsibility for such actions.
  4. Emergency Response
    If a member's ID or password is discovered by a third party or is suspected of being misused, the member must immediately notify our company. If our company issues relevant instructions, the member must follow them. Additionally, if our company suffers losses due to the improper use of the member ID and password, the member must compensate our company for the losses.
  5. Password Change Obligation
    Members are obligated to change their password regularly. Our company will not bear any responsibility for any losses caused by neglecting this obligation.
  6. Reissuance
    Except as specially recognized by our company, member IDs and passwords will not be reissued.

Article 5 (Service Content)

  1. Purchasing Service
    Our company accepts member requests to purchase items sold on internet websites (hereinafter referred to as "online shopping sites, etc.") operated by vendors in Japan through mail order and delivers the items to the members. The verification of the origin, manufacturing process, contents, type, quality assurance, authenticity, inspection, or after-sales service of the items is not within the scope of our services. If the member has issues with the purchased items related to the above, they cannot request returns, exchanges, or refunds through our company. Purchased items cannot be canceled, returned, or exchanged in any form.
  2. Forwarding Service
    This service provides forwarding for items purchased from domestic Japanese companies. Our company is responsible for receiving and forwarding the items purchased by the member, but we are not a party to the sales contract between the vendor and the member. Therefore, we are not responsible for any disputes regarding item defects, shipping errors, delays, returns, or other issues (including but not limited to defects, shipping errors, incorrect names or addresses, omission or errors in personal forwarding codes, price disputes, delayed shipments, returns due to undelivered items, intellectual property infringement, etc.). By using this service, the member authorizes our company to sign for the items on behalf of the member, and ownership of the items will transfer to the member upon receipt by our company.
  3. Receipt and Ownership Transfer
    By using this service, the member authorizes our company to sign for the items on their behalf, and ownership of the items will transfer to the member upon receipt. Our company is only responsible for the purchase and delivery of the items designated by the member. We do not assume any responsibility for inquiries, complaints, or warranties related to the items. Our company will not be liable for any losses suffered by the member due to delivery accidents such as non-delivery, delayed delivery, or damage to items caused by circumstances beyond our control.
  4. Service Scope
    The retailers, shipping companies, and item types, sizes, weights, amounts, and delivery locations that can use this service are limited to those specified by our company. Members may not use this service beyond these specified limits.
  5. Fees and Terms of Use
    The content, fees, usage methods, and terms of use for this service are as described on the service website. Members must fully understand and agree to the relevant content before using this service.

Article 6 (Handling of Personal Information)

The company will handle members' personal information in accordance with the "Privacy Policy." By using this service, members agree to and accept the company's "Privacy Policy." For specific details, please refer to the "Privacy Policy" on our website.

Article 7 (Service Fees and Payments)

  1. Service Fees
    Our company reserves the right to adjust and change the content, fees, and terms of use for this service at any time. Members must pay the service fees within the specified period using the method designated by our company. Unpaid fees beyond the deadline will incur a delay damage fee at an annual interest rate of 14.6%, and membership may be revoked.
  2. Storage and Other Fees
    Our company provides 30 days of free storage. After this period, storage fees will be charged. If the member fails to meet the requirements specified by our company for more than 180 days, our company will consider the items abandoned by the member and will dispose of them at its discretion. Our company will not be responsible for any losses caused by this, and the fees already paid will not be refunded. This clause also applies if the items are sent out and returned to our company due to the member's failure to receive them. Our company reserves the right to charge the member for the costs incurred by disposing of the items, and the member agrees to pay these fees.
  3. Shipping and Additional Fees
    The service fees include the shipping fees and various service fees from our company to the member's location. If customs duties, return shipping fees, or additional costs are incurred due to late pickup or other reasons, these fees will be borne by the member. Our company is not obligated to advance any fees.
  4. Item Inspection
    Our company has the right to open packages to check for prohibited items and verify the accuracy of the declaration. However, our company is not obligated to inspect items, and the inspection results do not guarantee the quality, defect-free condition, authenticity of the items, or compliance with the laws and regulations of the shipping origin, transit location, or destination.

Article 8 (Prohibited Items)

  1. Prohibited Items for Shipping
    The following items are prohibited from being shipped using this service:
    1. Cash, checks, bills of exchange, securities, and other valuable securities;
    2. Credit cards, cash cards, bankbooks, and ATM cards;
    3. Letters or communications defined as letters by current laws;
    4. Live animals or plants, dead animals, or animal specimens;
    5. Perishable or spoilable beverages and food items;
    6. Drugs, firearms, weapons, explosives, toxic chemicals;
    7. Child pornography, adult pornography, and other obscene materials;
    8. Items prohibited or restricted by laws and regulations;
    9. Any other items deemed inappropriate by our company.
    The member will be responsible for any losses or legal liabilities arising from the shipment of prohibited items.
  2. Prohibited Behavior
    Members may not engage in the following behaviors when using this service:
    1. Using this service for improper purposes;
    2. Using post-payment checkout methods such as 'bank transfer,' 'postal transfer,' or 'convenience store payment' for forwarding services;
    3. Infringing on the trademark rights, copyright, design rights, patent rights, portrait rights, advertising rights, or other rights of our company or third parties;
    4. Engaging in fraudulent or criminal activities;
    5. Using someone else's name to use this service;
    6. Improperly using our company's or third parties' equipment, or engaging in activities that interfere with operations;
    7. Violating laws, regulations, these terms, and public order and morals;
    8. Sending repeated or insulting, threatening, or defamatory content;
    9. Interfering with the operation of this service;
    10. Engaging in any other behaviors deemed inappropriate by our company.
    If a member violates these terms and causes our company to suffer losses, our company may require the member to compensate for the losses.

Article 9 (Applicable Law and Jurisdiction)

These terms are governed by Japanese law. If a dispute arises from these terms and cannot be resolved through negotiation, it will be submitted to the Tokyo District Court as the exclusive court of first instance.

Article 10 (Refusal to Provide Service and Handling of Undeliverable Items)

  1. Refusal to Provide Service
    If our company discovers that a member has violated these terms or engaged in inappropriate behavior, we reserve the right to refuse to provide this service. Situations include, but are not limited to:
    1. The member violates the prohibited items listed in Article 8;
    2. The member's location or the delivery address cannot be confirmed;
    3. The member refuses to receive the items;
    4. The items are detained by customs;
    5. The member fails to pay the fees or poses a payment risk;
    6. Any other situations deemed inappropriate by our company.
    Members who are refused service may lose access to their accounts, and fees already paid will not be refunded.
  2. Handling of Undeliverable Items
    When items cannot be delivered due to the reasons described in this article, our company will store the items for 30 days (excluding prohibited items). During this period, if the member fails to resolve the issue, our company has the right to handle the items, including but not limited to selling, discarding, or returning them, and the member has no objections to this.
  3. Responsibility for Disposal of Items
    Even if the member suffers a loss due to the disposal of items according to this article, our company will not be held responsible. Our company reserves the right to dispose of items in accordance with the Civil Execution Law.
  4. Member Responsibility
    Our company does not participate in the actual transportation of goods. If the member receives a request from the transportation company or customs for additional customs clearance documents or pick-up arrangements during transportation, the member must respond promptly. Any losses caused by the member's failure to clear customs or pick up items on time will be borne by the member.

Article 11 (Service Changes and Interruptions)

  1. Service Changes and Discontinuation
    Our company may change or discontinue the content of this service at any time without prior notice. We will not be responsible for any inconvenience or losses caused by service changes or discontinuation.
  2. Service Interruptions and Suspension
    Our company may temporarily interrupt or suspend all or part of this service without prior notice in the following situations:
    1. Maintenance of equipment or systems;
    2. Fires, power outages, natural disasters, or system failures;
    3. Telecommunication companies are unable to provide services;
    4. Hacking or viruses;
    5. Any other situations deemed necessary by our company.
    We will not be responsible for any losses caused by service interruptions or suspensions.

Article 12 (Scope of Company Responsibility)

  1. Scope of Responsibility
    Our company will not be responsible for any direct or indirect losses, loss of profit, special damages, or other unspecified damages suffered by the member due to the use of this service.
  2. Service Guarantee
    Our company does not guarantee that the items purchased through this service can be successfully purchased on shopping websites. We will not be responsible for any losses suffered by the member due to the use of websites or services not operated by our company.
  3. Shipping Responsibility
    Our company does not participate in the actual transportation of goods. In the event of loss or damage during transit, whether compensation can be obtained and the amount will be determined by the shipping company's investigation.
  4. Information Accuracy
    Our company is not responsible for the accuracy or completeness of any information obtained by the member through the website, especially content generated by automatic translation systems.
  5. Virus and Network Security
    Our company does not guarantee that the member will not be affected by viruses or other harmful programs while using this website or service.
  6. Loss Limitation
    The amount of compensation for any loss suffered by the member due to the use of this service will not exceed the service fees paid by the member to our company.
  7. Other Liability Exclusions
    Any other liabilities not explicitly stated in these terms are not within the scope of our company's responsibility.

Article 13 (Exclusion of Antisocial Forces)

  1. Declarations and Commitments
    The member declares that they do not meet any of the following conditions as of the contract signing date and commits that they will not meet them in the future:
    1. Organized crime groups;
    2. Members of organized crime groups;
    3. Associate members of organized crime groups;
    4. Companies affiliated with organized crime groups;
    5. Groups engaging in criminal activities under the guise of social movements, high-intelligence violent crime groups, etc.;
    6. Individuals with social or economic ties to the above;
    7. Other similar situations.
  2. Prohibited Behavior
    The member commits not to personally or through third parties engage in the following behaviors:
    1. Violent threats;
    2. Unjust demands for money;
    3. Actions that damage others' reputations or interfere with others' businesses;
    4. Other similar behaviors.
  3. Contract Termination
    If the member is found to meet any of the above conditions or engage in any of the above behaviors, our company may immediately terminate the contract without bearing any responsibility.

Article 14 (Termination of Service)

If a member passes away, our company will consider the membership terminated as of that time, and the member ID and password will no longer be usable. After termination, any remaining member benefits (including but not limited to unused points, coupons, etc.) will automatically expire, and our company will not be responsible for any losses.

Article 15 (Supplementary Provisions)

  1. Our company reserves the right to interpret these terms, and members must comply with the provisions of these terms when using the service.
  2. The interpretation and application of these terms are governed by Japanese law. In the event of a dispute, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
